1.Whereas

These Terms and Conditions of sale regulate the supply of Caffe’ Alma products made via https://www.caffealma.com (“The Website”) or via e-mail to info@caffealma.com . These Terms and Conditions of sale are compliant with the applicable Consumer protection and e-commerce transactions laws.

The applicable General Terms and Conditions are those in force at the time of conclusion of the order confirmation. By placing a purchase order, the Customer declares to be aware of and fully accept the conditions of sale. Their acceptance is a necessary condition for the conclusion of the contract.


2.Parties of the Agreement

The Parties of the Agreement are:

- Caffe’ Alma: Caffe’ Alma di Alvisi Alessandro, with registered office in Cinto Euganeo (PD), Via Minelle 9, ITALY, VAT number 05413710285.

- Customer: the end user is either a natural person (as long as he or she is of legal age at the date of conclusion of the contract) or a legal person (e.g.: professionals, small companies). For large companies there are further forms of agreement.


3.Products: Features and Price

The main features of the products can be found on the Website, on the related product section.

The products delivered to the Customer have a remaining shelf life of more than 6 months.

The products are sold at the price (VAT included) indicated on the Website at the time of the purchase.

Price does not include delivery costs, which will in any case be indicated separately in the final summary section before confirming the order, and in any case specified in the confirmation of receipt of the order sent by e-mail to the Customer.


4.Conclusion of the contract

The Customer can purchase in two different ways:

  1. a) via Website (www.caffealma.com)
  2. b) via e-mail (info@caffealma.com)

The registration is optional to purchase online.

If the Customer does not wish to register, he/she can still conclude a purchase without registration: in this case only the data necessary for the delivery and possible invoicing of the order will be requested.

In case of registration, the Customer is required to maintain the confidentiality and security of his/her Credentials which shall remain under his/her responsibility. Any successful login using the Credentials of the Customer, regardless of whether it was executed by the effective owner or someone else, shall be deemed as a personal access by the Customer. Caffe’ Alma is not liable for any loss or damage in failure to comply with such contractual provisions.The Customer undertakes to notify immediately Caffe’ Alma if he/she knows or has reason to believe that his/her Credentials have been stolen or misused, or in case of any other security issue.

Once the purchase order has been received, Caffe’ Alma will send a confirmation by e-mail. Such communication includes the summary of the undersigned terms and conditions and further details according to the applicable regulation relating to the rights of Consumers. The agreement is deemed accepted as soon as the Customer receives the confirmation from the Caffe’ Alma. Caffe’ Alma will verify the availability of the ordered Product and, only after such verification, will communicate by e-mail its acceptance and start the procedures for the shipment of the product. In case Caffe’ Alma is not able to fulfill an order received, it will promptly notify the Customer. In this case the order will be considered cancelled and no amount will be charged to the Customer.

Any right of the Customer to damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or things caused by the non-acceptance of an order.


5.Sale conditions

The quantities of Products that can be ordered may be subject to minimum or maximum quantity limitations at Caffe’ Almas discretion, based on active promotions.

The language available to conclude the contract is English.


6.Payment

Caffe’ Alma accepts payments only through the systems listed below:

  1. Credit card: American Express, Visa, Mastercard, Maestro, methods provided by Shopify Payments. This information is not stored and/or archived by Caffe’ Alma. In no case can Caffe’ Alma therefore be held liable for any fraudulent or improper use of credit cards by third parties, whose details were communicated at the time of payment of the purchased products.
  2. PayPal: online payment system that allows any company or consumer who has an e-mail address to send and receive payments, subject to registration. Payment is made through the PayPal payment platform.
  3. ApplePay, method provided by Shopify Payments
  4. Google Pay, method provided by Shopify Payments
  5. Other methods provided by Shopify Payments: Shop Pay, Bancontact, iDEAL
  6. Wire Transfer

7.Delivery

The products are delivered by Caffe’ Alma only and exclusively in the destination indicated in the order.Caffe’ Alma does not accept shipments to P.O. Boxes

Caffe’ Alma will ship the products ordered by the Customer, by courier, to the address indicated by the same at the time of purchase, approximately within 24 working hours of acceptance of the order. Delivery generally takes place within 4 working days. The times indicated for the receipt of the goods are indicative.

Delivery charges are calculated on the basis of the rates indicated on the Site or communicated by Customer Service at the moment of the purchase.

The shipment will be made by Caffe 'Alma by courier, which is responsible for the delivery.


8.Product check

Any damage to the packaging and/or the product (visible without the need to open the package), or mismatch in the number of packages must be immediately reported, giving specific indication of the delivery document. By signing the courier's document, the Customer certifies the external integrity of the product and the conformity of the delivery.

Any problems regarding the physical integrity, correspondence or completeness of the products received must be reported by sending an email to info@caffealma.com.


9.Billing

Caffe 'Alma will issue an invoice for each order placed by a company for amounts exceeding 77.47 Euros, while in the other cases only upon request. The information provided by the Customer at the time of registration or when placing an order will be used to issue the invoice, also providing for the possibility of indicating addresses other than those indicated for shipping. No change in the data indicated on the invoice will be possible after it has been issued.


10.Withdrawal

With specific reference to food products the withdrawal right is not allowed.


11.Force Majeure

Caffe’ Alma cannot be held responsible if it is unable to process the order or is late in processing it due to force majeure (for example, but not limited to, production blocks imposed by legislative or administrative measures, epidemics, strikes, severe weather events, fires, floods), even if such events prevent or delay the activity of the courier in charge of delivering the ordered product.


12.Law and jurisdiction

These Terms and Conditions of sale are governed by the regulations of Italy.

In the case of civil disputes, the judge of the Client's place of residence or domicile will have exclusive jurisdiction, in accordance with the applicable consumer law.


13.Final provisions

The European Commission provides a platform for the resolution of disputes relating to purchases made online, which the citizen of an EU member country can access through this link: http://ec.europa.eu/consumers/odr/. This tool can be used by the European Customer for the extrajudicial resolution of any dispute arising from the purchase of Products on www.caffealma.com. Alternatively, the Customer may use other methods for resolving disputes at his choice.

Caffe 'Alma protects the privacy of its customers and guarantees that data processing complies with the provisions of the privacy legislation (GDPR 679/2016 and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018) .
